Abstract
This Act deals with the importation, procedures, diseases of animals. It also has the aspect of "power of verification, control and quarantine of animals coming from abroad....."
Under section 3 of the Act, any person who intends to sell chemical fertilizers need to obtain a licence and such licence is subject to the terms and conditions as the Minister may determine and also upon payment of a prescribed fee.
Under section 4, no chemical fertilizers shall be sold unless in completely sealed containers and properly labeled. Section 5 gives a sampling officer the power to enter premises to inspect area where chemical fertilizers are stored at all reasonable times. Under subsection 2 the sampling officer may also demand a sample for chemical fertilizer for analysis.
Section 6 and 7 deals with the certificate of analysis and the sample to be produced whenever there it is the subject of legal proceedings in court respectively.
Any breach of the provisions of the Act entitles the Permanent Secretary to seize the chemical fertilizer (section 8) and any person who sells chemical fertilizer contrary to section 9 of the Act commits an offence and if convicted shall be liable to a fine and to imprisonment and the fertilizer be forfeited.
